Holding

The appeal is dismissed, upholding the trial court’s order rejecting anticipatory bail.

Summary

The appellant, Chitranjan Pandey, appealed to the Patna High Court against an order dated 28‑08‑2025 that denied his anticipatory bail. The trial court had recorded the appellant as one of the assailants in a case involving offences under sections 126(2), 115(2), 109, 103(1), 351(2) and 3(5) of the Indian Penal Code, as well as sections 3(i)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The appellant argued that the nature of the allegations did not warrant a denial of anticipatory bail. The High Court examined the seriousness of the charges, the alleged involvement of the appellant, and the statutory provisions governing anticipatory bail. Finding that the facts and the gravity of the offences justified the trial court’s decision, the Court dismissed the appeal. Consequently, the order rejecting anticipatory bail stands.

Issues considered

  • Whether anticipatory bail should be granted to the appellant in view of the offences alleged under the IPC and the SC/ST (Prevention of Atrocities) Act
  • Whether the nature and seriousness of the charges warrant a denial of anticipatory bail
