Holding
The High Court set aside the order rejecting anticipatory bail and granted bail to the appellant with conditions.
Summary
Ramlayak Singh appealed against the order of a Special Judge that rejected his anticipatory bail application in a case where he was accused of killing a man who was beating his wife. The prosecution charged him under Section 105 of the BNS Act and several provisions of the SC/ST (Prevention of Atrocities) Act. The appellant argued that he was falsely implicated, that he intervened to separate the couple, and that the incident amounted only to culpable homicide, not murder. The State opposed the bail. The Patna High Court held that the anticipatory bail application was maintainable, set aside the Special Judge’s order, and directed that the appellant be released on bail with specified conditions. Consequently, the appeal was allowed.
Issues considered
- Whether anticipatory bail is maintainable in a case involving offences under the BNS Act and the SC/ST (Prevention of Atrocities) Act.
- Whether the alleged act constitutes murder or culpable homicide not amounting to murder.
- Whether the SC/ST status of the deceased influences the grant of anticipatory bail.
