Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The High Court set aside the trial court’s denial of bail and granted bail to the appellants with conditions.

Summary

The appellants, Chandan Kumar and Guddu Kumar, appealed to the Patna High Court under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the trial court's order rejecting their bail application. The prosecution alleged that the appellants, along with others, assaulted an informant with the butt of a .303 rifle and an iron rod and used caste-based slurs, invoking several IPC and SC/ST Act provisions. The appellants contended that the case was fabricated, noting the absence of any injury report and arguing that the allegations were vague and did not attract the SC/ST Act. The State opposed bail, maintaining that the accusations of assault and caste abuse were substantiated. The High Court set aside the trial court’s order, granting bail on a bond of Rs.10,000 with two sureties and imposing conditions such as non‑contact with the informant and verification of criminal antecedents. The court clarified that any observations in the bail order would not affect the trial, and the criminal appeal was allowed.

Issues considered

  • Whether the trial court was justified in rejecting bail for the appellants under the SC/ST (Prevention of Atrocities) Act, 1989.
  • Whether the allegations of assault and caste-based abuse sufficiently attract the provisions of the SC/ST Act.
  • Whether the appellants are entitled to bail pending trial despite the serious nature of the charges.

                       3. As per the prosecution case, the allegation against

the appellants is that they assaulted the informant with the butt
