Holding
The appeal is allowed; the order refusing bail is set aside and the appellants are released on bail.
Summary
The appellants – Somali Manjhi, Anil Manjhi and Gauri Devi – appealed against the refusal of bail granted by the Exclusive Special Judge, SC/ST Act, Nawada in a case alleging murder of an informant’s husband and an attempt to burn the informant, Samudri Devi. The charges were framed under several provisions of the Bharatiya Nyaya Sanhita, 2023, the Bihar Witch‑Crafts Practice Act and Sections 3(1)(r)(s) and 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The appellants contended that they were falsely implicated, had no specific allegation of caste‑based insult, possessed no criminal antecedent and had been in custody since 28‑08‑2025, thus warranting bail. The State opposed bail, arguing the seriousness of the offences. The High Court set aside the lower court’s order, granted bail on a bond of Rs 10,000 with two sureties, and allowed the appeal.
Issues considered
- Whether the appellants are entitled to bail under the SC/ST Act despite the serious nature of the alleged offences.
- Whether the alleged conduct amounts to an offence under Sections 3(1)(r)(s) and 3(2)(v) of the SC/ST Act (i.e., caste‑based insult or disgrace).
- Whether the lower court’s refusal to grant bail was justified in view of the lack of specific allegations against the appellants and their custodial period.
