Holding

The High Court held that no offence under the SC/ST Act is made out and consequently granted anticipatory bail to the appellant.

Summary

Chhotu Rai appealed against the denial of anticipatory bail in a case filed under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and several IPC provisions. The FIR alleged that he, along with co‑accused, abused and assaulted an informant using caste slurs, but the High Court found no specific allegation of assault against him and noted that the alleged incident occurred inside the informant’s private house, not a public place. The appellant argued that he has a clean antecedent and that the FIR is fabricated. The Special Public Prosecutor opposed bail, claiming the appellant’s participation in the crime. The Court held that the facts do not constitute an offence under the SC/ST Act and, considering the appellant’s clean record, granted anticipatory bail with conditions, setting aside the lower court’s order.

Issues considered

  • Whether the facts disclosed in the FIR constitute an offence punishable under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
  • Whether anticipatory bail under Section 438 CrPC can be granted in the present circumstances.
  • Whether the private nature of the alleged incident bars the application of the SC/ST Act.
