The appeal is allowed and the order rejecting anticipatory bail is set aside.

Summary

The appellants, a group of seven men from Pirwan village, were charged in a 2019 case for assaulting a Dalit woman, Pushpa Kumari, at a temple, snatching her golden chain, and later assaulting her family, under multiple IPC sections and the SC/ST (Prevention of Atrocities) Act. The Special Judge had rejected their anticipatory bail application. The appellants contended that they were falsely implicated, noting that the police investigation later exonerated them. The State opposed the bail. The Patna High Court, after considering the submissions, set aside the Special Judge's order rejecting anticipatory bail and allowed the appeal, directing that the appellants be released on bail upon furnishing bonds and sureties, subject to conditions under CrPC provisions.

Issues considered

  • Whether the anticipatory bail granted to the appellants should be upheld despite the Special Judge's rejection.
  • Whether the facts constitute an offence under the SC/ST (Prevention of Atrocities) Act, section 3(1)(r)(s).
  • Whether the appellants were correctly implicated based on the police investigation and evidence.
