The appeal is allowed; the order rejecting bail is set aside and the appellants are directed to be released on bail.

Summary

Anita Devi and Gorelal Singh, parents of alleged offender Niraj Kumar, were arrested in connection with a case involving alleged caste‑based abuse, assault, and a false promise of marriage leading to a pregnancy and medical termination. The FIR primarily named Niraj, but the parents were impleaded as accused under several sections of the Bihar N.S. and the SC/ST (Prevention of Atrocities) Act. They contended that they were falsely implicated, had no prior criminal record, and had been in judicial custody since 1 November 2025. Their bail application was rejected by the Exclusive Special Judge on 7 November 2025. On appeal, the Patna High Court, after hearing counsel for the appellants, the State and the respondent, held that the circumstances warranted bail and set aside the lower court’s order, directing that the appellants be released on a bail bond of Rs.10,000 each with two sureties.

Issues considered

  • Whether the appellants, who are parents of the principal accused, are entitled to bail despite the serious charges under the Bihar N.S. and SC/ST (POA) Act.
  • Whether the allegations of caste‑based abuse and assault against the appellants constitute a cognizable offence justifying denial of bail.

Subjects

  • bail
  • SC/ST Act
