The Court held that bail may be granted to a juvenile under the JJ Act, subject to appropriate conditions, and set aside the earlier order denying bail.
Summary
The appellant, a child in conflict with law, was accused of abducting an informant's daughter and having a physical relationship with her. The appellant argued that he was a juvenile, being under eighteen at the time of the alleged offence, and invoked the Juvenile Justice (Care and Protection of Children) Act, 2015, specifically Sections 3(i), (iv), (v), (xiv) and Section 12, asserting that bail is the rule and denial is an exception for juveniles. The counsel further highlighted that the appellant had been in custody since 25‑01‑2025 and that the lower court had not considered the statutory provisions for release of a juvenile. The High Court, after considering these submissions, set aside the earlier order dated 24‑05‑2025 and granted bail on a bond of Rs.10,000 with two sureties, imposing conditions that the appellant's father act as a bailor, file an undertaking affidavit, and ensure the appellant's cooperation in the trial. The bail order was conditioned on compliance, with default leading to cancellation of the bond.
Issues considered
- Whether a child in conflict with law, accused of abduction and sexual intercourse, is entitled to bail under the Juvenile Justice (Care and Protection of Children) Act, 2015.
- Whether the provisions of Section 3 and Section 12 of the JJ Act make denial of bail an exception for juveniles.
