RANJEET SINGH KRISHNA @ RANJEET SINGH @ KRISHNA SINGHversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail is not maintainable in the present circumstances.

Summary

The appellant Ranjeet Singh Krishna was charged under IPC sections 354A, 354B, 509 and Section 3(ii)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for alleged molestation of the victim. He filed an anticipatory bail application before the Special Judge, which was rejected, leading to the present appeal. The High Court examined whether anticipatory bail could be granted in a case involving serious sexual offences and caste‑based atrocity provisions. Relying on the gravity of the allegations and the nature of the offences, the Court held that the anticipatory bail application was not maintainable. Consequently, the appeal was dismissed, with liberty to the appellant to surrender before the lower court and seek regular bail.
