Holding

The appellate court set aside the order rejecting anticipatory bail and granted bail to the appellant.

Summary

The appeal concerned the rejection of anticipatory bail for Mohan Kumar Singh, brother‑in‑law of a Scheduled Caste informant who alleged caste‑based abuse, dowry harassment and forced eviction after an inter‑caste marriage. The charges were under IPC §§ 323, 498A, Dowry Prohibition Act §4 and SC/ST Act §3(i)(r)(s). The appellant contended that the alleged acts were not committed in public view, that he had a clean antecedent, and that co‑accused had already been granted anticipatory bail. The High Court examined the requirement of public view for offences under the SC/ST Act and held that no case was made out against the appellant. Accordingly, it set aside the Special Judge’s order, allowed the appeal and directed that the appellant be released on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether anticipatory bail can be granted to the appellant under IPC §§ 323, 498A, Dowry Prohibition Act §4 and SC/ST Act §3(i)(r)(s).
  • Whether the alleged conduct falls within the ambit of the SC/ST Act, which requires the offence to be committed in public view.
  • Whether the appellant’s clean antecedent and the bail granted to co‑accused affect the bail decision.
