Patna High Court

Kamlesh KumarversusThe State of Bihar

Decided

DISMISSED

Holding

The appeal is not maintainable and is dismissed.

Summary

Kamlesh Kumar appealed to the Patna High Court seeking to set aside the order of the Exclusive Special Court, SC/ST Act, Patna, which had rejected his anticipatory bail application in a case involving offences under Sections 420, 341, 352, 323, 504 of the IPC and Section 3(1)(g)(r)(s) of the SC/ST Act. The State argued that the lower court had already taken cognizance of the matter under the SC/ST Act, making the appeal for anticipatory bail non‑maintainable. The High Court relied on the Supreme Court’s decision in Bachu Das v. State of Bihar (2014) 3 SCC 471, which held that once cognizance is taken, a pre‑arrest bail petition cannot be entertained. Accordingly, the Court dismissed the appeal as not maintainable. The order was pronounced by Justice Prabhat Kumar Singh.
