The order rejecting anticipatory bail was set aside and bail was granted to the appellants.
Summary
The appellants appealed against an order dated 20‑11‑2024 that denied them anticipatory bail in a case registered under several sections of the B.N.S. and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The prosecution alleged that the appellants assaulted the informant with lathi, danda and stones and abused them on caste grounds. The appellants contended that the allegations were vague, that the dispute arose from the informant’s livestock grazing on their field, and that no specific overt act was proved, emphasizing their clean antecedents. The Special Public Prosecutor opposed bail, but the High Court noted the general and omnibus nature of the accusations and the lack of concrete evidence. Consequently, the Court set aside the lower court’s order for the appellants, granting them bail on furnishing a bond of Rs. 10,000 with two sureties each.
Issues considered
- Whether the denial of anticipatory bail was justified in view of the alleged offences under the B.N.S. and the SC/ST (Prevention of Atrocities) Act.
- Whether the prosecution established specific overt acts of assault and caste‑based atrocity sufficient to deny bail.
- Whether the appellants are entitled to bail given their clean antecedents and the vague nature of the allegations.
