The order rejecting bail is set aside and bail is granted to the appellant.

Summary

The appellant, Kamaldeo Yadav, appealed against the order of the Exclusive Special Judge that rejected his bail application in a case involving offences under several sections of the BNS, the Arms Act and the SC/ST (POA) Act. The prosecution alleged that Yadav was part of an unlawful assembly that shot the deceased, while the defence argued that he was merely a member of the assembly with no specific role in the shooting. The High Court examined the nature of the allegations, the appellant's custody period, and the lack of direct involvement. It concluded that the bail rejection was unwarranted and set aside the lower court's order. Consequently, the court granted bail on condition of a Rs.10,000 bond with two sureties and directed the appellant to cooperate with the trial.

Issues considered

  • Whether the appellant, alleged to be a member of an unlawful assembly, is entitled to bail despite charges under Sections 126(2), 115(2), 103(1), 352, 61(2) of the BNS, Section 27 of the Arms Act and Sections 3(1)(r)(s), 3(2)(v) of the SC/ST (POA) Act.
  • Whether the appellant's alleged role, or lack thereof, justifies the grant of bail.
