DISMISSED

Holding

The bail application was dismissed, denying the petitioner any relief.

Summary

The petitioner, Pintu Kumar, was arrested in connection with a robbery in which Rs. 3,62,200 was allegedly stolen from Vishwam Kumar, and was charged under Section 309(6) of the B.N.S. and Sections 25(1‑B)(a) and 26(1) of the Arms Act. The petitioner contended that he had been falsely implicated, despite having eight prior criminal cases, and had been in custody since 21‑07‑2025, offering to cooperate with the investigation. The State opposed bail, relying on the petitioner’s confessional statement that admitted guilt. The Court examined the seriousness of the offences, the existence of a confession, and the petitioner’s criminal antecedents. Concluding that the gravity of the offences outweighed the petitioner’s assurances, the Court refused to grant bail and dismissed the application.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences and his confession.
  • Whether the petitioner’s claim of false implication and his prior criminal antecedents affect the bail decision.
