Patna High Court

Aman Kumar SinghversusThe State of Bihar

Decided

Holding

The court held that bail should be granted to the petitioner subject to specified conditions.

Summary

Aman Kumar Singh was arrested in connection with a case involving the recovery of a large quantity of arms and ammunition from a co-accused's house. He was charged under Sections 25(9), 25(1‑B)a, 26 and 35 of the Arms Act and had been in custody since 25‑11‑2025, claiming a clean antecedent. The petitioner applied for regular bail, asserting innocence, while the State opposed the relief. The Patna High Court, after considering the circumstances, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to comply with attendance and cooperation conditions. The order emphasized that the observations were prima facie and not to influence the trial's merits.

Issues considered

  • Whether regular bail can be granted to an accused charged under Sections 25(9), 25(1‑B)a, 26 and 35 of the Arms Act.
  • Whether the petitioner’s clean antecedent and willingness to cooperate justify bail despite the seriousness of the offences.
