Patna High Court

Sagir AnsariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petition for anticipatory bail is allowed, subject to the stipulated conditions.

Summary

Petitioner Sagir Ansari, the brother‑in‑law of a deceased woman, feared arrest in a murder case (Jagdishpur P.S. Case No. 192 of 2025) where seven accused were alleged to have killed the informant's daughter under Sections 80/3(5) of the B.N.S. He argued that no specific allegation linked him to the crime, he lived separately, and he has a clean antecedent. The State opposed his anticipatory bail. The High Court, after considering the submissions and the circumstances, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and several conditions, invoking Section 438(2) of the CrPC and Section 482(2) of the B.N.S. The order emphasized that the bail conditions could be cancelled for non‑compliance or future involvement in similar offences, and that the observations would not affect the trial.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC.
  • Whether the petitioner is likely to be involved in the alleged murder offence.
  • Whether the conditions imposed are appropriate and lawful under the relevant statutes.
