The court granted bail to the petitioner.

Summary

The petitioner, Nahid Alam, sought bail in a theft case (PS Jiyapokhar Case No. 36 of 2025) charged under Sections 331(4) and 305 of the B.N.S. The prosecution alleged that unknown miscreants stole a suitcase containing valuables and cash, and that the petitioner, after being apprehended, disclosed the names of three co‑accused. The petitioner contended his innocence, highlighted that a bag was recovered based on his disclosure, no theft‑in‑possession (T.I.P.) was conducted, and that the recovered mobile belonged to him; he also pointed out that the co‑accused had already been granted bail and that he had no prior criminal record, having been in judicial custody since 25‑11‑2025. The State opposed bail. After hearing both sides, the court found the circumstances sufficient to grant bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties of equal amount.
