Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Arun Kumar Yadav, the manager of a hospital, was arrested in connection with the death of the informant's mother, who allegedly died due to negligence during a surgical operation. The prosecution charged him under Sections 103(1) and 3(5) of the B.N.S., alleging his involvement in the alleged negligence. The petitioner contended that he had no role in the medical treatment, that the operation was performed by co‑accused Dr. Satish Kumar, and that his implication was merely because of his managerial position. The State opposed the bail application, arguing the seriousness of the charges. The Court, considering the general and omnibus nature of the accusation and the length of the petitioner’s custody since 28‑12‑2025, granted bail on a bond of Rs.10,000 with two sureties.
