Patna High Court

Sanjiv Kumar Manjhi @ Sanjiv ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to a bond of Rs.10,000 and two sureties.

Summary

The petitioner, Sanjiv Kumar Manjhi, was arrested in connection with a case registered under sections 363, 365 and 376 of the Indian Penal Code for allegedly kidnapping the sister of an informant and establishing a sexual relationship with her. He has been in custody since 16 September 2025. The sister’s statement, recorded under section 183 of the B.N.S.S., indicated that she had eloped with the petitioner, suggesting a consensual relationship. The petitioner applied for bail, arguing that the prolonged detention was unwarranted. The Court, after considering the statement and the period of custody, allowed the bail application, directing release on a bond of Rs.10,000 with two sureties, while expressly stating that it was not passing on the merits of the criminal charges.

Issues considered

  • Whether bail should be granted to the accused in a case involving kidnapping, extortion and rape under sections 363, 365 and 376 IPC.
  • Whether the statement recorded under section 183 of the B.N.S.S. and the length of pre‑trial detention justify bail.
