Holding

The Court held that bail could not be granted to the petitioner.

Summary

The petitioner, Satyendra Kumar, applied for bail in a case registered under sections 406, 420 and 120‑B of the Indian Penal Code, alleging non‑payment of rent for a truck given to him on rent. The prosecution alleged that the petitioner defaulted on the rent, constituting criminal breach of trust, cheating and conspiracy. The petitioner has been in custody since 1 March 2025 and is already accused in 80 other criminal cases. The Patna High Court, after hearing counsel, considered the seriousness of the offences and the petitioner’s extensive criminal antecedents. Concluding that the circumstances did not warrant bail, the Court rejected the bail application, clarifying that its observations are limited to this bail application and do not prejudice the trial.
