Patna High Court

Brajesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, subject to conditions.

Summary

The petitioner, Brajesh Kumar, was charged under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act for allegedly keeping the motorcycle used in a murder. The prosecution alleged that the deceased was killed by hired criminals at the behest of Vinay Kumar Singh, and the motorcycles were left at the petitioner's residence. The petitioner contended his innocence, noting that co‑accused Rohit Raj and Harsh Raj had already been granted bail and that no charge‑sheeted witness had been examined despite charges being framed on 25‑08‑2025. Considering the prolonged custody since 03‑01‑2024, the delay in trial, and the bail granted to other accused, the court allowed the petition for regular bail. The court ordered release on a bail bond of Rs.10,000 with two sureties and imposed conditions of monthly police station attendance and cooperation with the trial court.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences and the pending trial.
  • Whether the delay in trial and the grant of bail to co‑accused warrant bail for the petitioner.
