Decided
Disposal
DISMISSED

Holding

The Court denied pre‑arrest bail to the petitioner.

Summary

The petitioner, Md. Kasim, was implicated in a rape case (Manihari P.S. Case No. 2 of 2010) alleged to have been committed on 17 March 2009, punishable under Section 376 of the Indian Penal Code. He applied for pre‑arrest bail, asserting his innocence, a clean antecedent, and that the accusation was merely suspicion. The State opposed the bail, emphasizing the specific allegation of rape. The Court examined the seriousness of the charge, the petitioner’s conduct, and the delay in filing the bail application. Considering these factors, the Court rejected the petition for pre‑arrest bail.

Issues considered

  • Whether pre‑arrest bail should be granted to the petitioner in a rape case under Section 376 IPC given the nature of the accusation, the petitioner’s conduct, and the delay in filing the application
