Holding

Bail was refused as the court was not inclined to enlarge the petitioner on bail in the murder case.

Summary

The petitioner, Ravindra Das, applied for bail in a murder case (Section 302 and 34 IPC) for which he has been in judicial custody since 18 October 2022. His earlier bail applications were rejected three times. The petitioner claimed innocence and argued that the trial was delayed, with only eleven of fourteen charge‑sheet witnesses examined. The State opposed bail, citing a direct allegation of firing against the petitioner supported by medical evidence. Considering the seriousness of the offence, the stage of the trial, and the evidence on record, the court refused the bail application and directed the trial court to expedite the proceedings.

Issues considered

  • Whether bail should be granted to the accused in a murder case (IPC Sections 302 and 34) given the stage of trial and the nature of evidence.
  • Whether the delay in trial and the petitioner’s claim of innocence warrant bail.
