Patna High Court

Chandan PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court grants anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

Petitioner Chandan Paswan sought anticipatory bail fearing arrest in a case registered under several sections of the Bharatiya Nagarik Suraksha Sanhita for allegedly assaulting an informant with a lathi. He claimed innocence, asserted no specific allegation against him, and highlighted his clean criminal record. The State opposed the bail. The court noted that the alleged injury was simple and the petitioner had no prior convictions, and therefore granted anticipatory bail subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the B.N.S.S., including a bail bond and sureties, cooperation with investigation, and verification of antecedents. The order directs that if the petitioner conceals any criminal antecedent, the bail may be cancelled. The bail is to be effected within four weeks of the order.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the allegations of assault under the B.N.S.S.
  • Whether the conditions under Section 438(2) CrPC and Section 482(2) B.N.S.S. are applicable in this case

                       5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                       6. Considering the aforesaid facts and circumstances

of the case and the fact that the allegation against the petitioner

is of assaulting Amit Raj on his head with lathi but the injury

petitioner has also clean antecedent, I am inclined to grant

                       7. Let the petitioner, as named above, in the event of

          investigation/trial.

(ii) the learned Court would, however, verify the

criminal antecedent of the petitioner and in case, it is found that

the petitioner has concealed his criminal antecedent, the Court

below shall take steps for cancellation of bail-bond of the
