Patna High Court

Raman Sahni @ Ravan SahniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a cash bond and specified conditions.

Summary

Raman Sahni was arrested on 4 November 2025 in connection with a June 2023 assault on the informant’s mother‑in‑law, allegedly using an iron rod, and charged under Sections 341, 323, 307, 354, 379, 427, 504 and 34 of the IPC. The petitioner argued that the incident stemmed from an admitted land dispute between agnate parties and that he has a clean criminal record, emphasizing the lack of intent to kill and that co‑accused had already been granted anticipatory bail by the same court. The State opposed bail, contending the seriousness of the offences. The Court considered the facts, the petitioner’s antecedents, and the precedent of anticipatory bail to co‑accused, and ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence. The bail order also directed verification of any concealed criminal antecedent, without delaying acceptance of the bond.

Issues considered

  • Whether bail should be granted to the petitioner charged with offences under Sections 341, 323, 307, 354, 379, 427, 504 and 34 IPC in the circumstances of a land‑dispute‑related assault.
  • Whether the prior grant of anticipatory bail to co‑accused influences the bail decision for the petitioner.
