Patna High Court

Laljee Singh @ Lalji SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Laljee Singh was implicated as the consignee of 2,772 litres of illicit foreign liquor seized from two vehicles, leading to charges under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was neither the owner nor the driver of the vehicles and that the accusation stemmed from enmity, having been in custody since 23 December 2025. The State opposed his bail application, while his counsel argued lack of direct involvement. The Court examined the facts, the nature of the offence, and the period of custody, and concluded that bail could be granted. Accordingly, the petitioner was released on bail upon furnishing a bail bond of Rs. 10,000 with two sureties of equal amount, subject to the satisfaction of the Special Judge, Excise – 2nd, Aurangabad.
