DISMISSED

Holding

The bail application was dismissed, and the petitioner was not granted bail.

Summary

The petitioner, Ghuntun Yadav, applied for regular bail in a case registered under Sections 111, 309(4) and 61(2) of the B.N.S. for allegedly looting Rs.44,900 from an informant. The prosecution alleged that the motorcycle used in the loot, captured on CCTV, belongs to the petitioner, linking him to the crime. The petitioner’s counsel argued that he was falsely implicated, has nine prior criminal antecedents, and has been in custody since 02‑07‑2025, offering to cooperate with the trial. The State opposed bail, emphasizing the CCTV evidence and the seriousness of the offences. The Court, after considering the material, declined to grant bail and dismissed the application.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the CCTV evidence linking his motorcycle to the loot
  • Whether the seriousness of the offences under Sections 111, 309(4) and 61(2) of the B.N.S. warrants denial of bail
