Patna High Court

Ajit Paswan @ Ajeet Kumar PaswanversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court denied bail, holding that the seriousness of the offences and the near‑completion of the trial preclude the grant of bail.

Summary

Ajit Paswan was charged with offences under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code, Section 27 of the Arms Act and later Section 302 of the IPC for allegedly shooting the son of an informant, resulting in the victim's death. The petitioner has been in custody since May 2022 and has filed three successive bail applications, all of which were rejected by the Patna High Court. The court noted that specific allegations of shooting, corroborated by post‑mortem findings and prosecution witnesses, were made against him. It also observed that the trial is already underway, with all prosecution witnesses examined and the trial nearing completion. Considering the gravity of the offences and the advanced stage of the trial, the court dismissed the latest bail application.

Issues considered

  • Whether bail should be granted to the accused given the seriousness of the offences and the stage of the trial
  • Whether the presence of specific allegations and corroborative evidence justifies denial of bail
