Patna High Court

Raju Ram @ Raju Kumar RamversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court denied bail to the petitioner, holding that the seriousness of the offences and his prior criminal record preclude granting regular bail at this stage.

Summary

The petitioner, Raju Ram, was charged under IPC sections 272 and 273 and the Bihar Prohibition and Excise Act sections 30(a) and 41(1) for allegedly possessing 171 litres of country-made liquor recovered from a bush. He claimed innocence, arguing that he was implicated solely on suspicion, while the prosecution highlighted five prior similar offences. The petitioner’s counsel sought regular bail, asserting that the case was baseless. The bench considered the seriousness of the offences, the volume of illicit liquor, and the petitioner’s criminal antecedents. Weighing these factors, the court declined to grant bail, directing that the petitioner may reapply after six months. The order reflects the court’s discretion to deny bail where the nature of the offence and prior record raise concerns.

Issues considered

  • Whether the petitioner is entitled to regular bail for offences under IPC sections 272, 273 and Bihar Prohibition and Excise Act sections 30(a), 41(1).
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
