BAIL GRANTED

Holding

Bail is granted to the petitioner.

Summary

The petitioner, Sanju Devi, a woman, was arrested in connection with an offence under Section 30(a) of the Bihar Prohibition and Excise Act after 120 litres of illicit country‑made liquor was recovered from the house of a co‑accused. She contended that nothing was recovered from her conscious possession and that she had no involvement in the alleged recovery. She had been in custody since 28‑11‑2025 and a chargesheet had been filed. The State opposed her bail application. The Court, taking note of the length of her custody, her gender, and the lack of any material linking her to the seized liquor, ordered her release on bail upon furnishing a bail‑bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Exclusive Special Excise Court‑III, Saran. The bail order was pronounced by Justice Prabhat Kumar Singh.
