Holding

The Court granted bail to the petitioner.

Summary

Aman Kumar was arrested in connection with a case registered under Sections 64(2) and 351(2) of the B.N.S., alleging that he had established a physical relationship with a woman on a false promise of marriage, created an objectionable video of her and threatened to ruin her. The petitioner contended that the relationship was consensual, that the allegations were false, and that he had no prior criminal record, having been in judicial custody since September 2025. The State opposed bail, arguing the seriousness of the alleged offences. After hearing both sides, the Court found that the allegations did not establish a clear risk of flight or tampering with evidence sufficient to deny bail. Consequently, the Court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner accused under Sections 64(2) and 351(2) of the B.N.S.
  • Whether the alleged consensual relationship and alleged threat constitute a prima facie case justifying denial of bail
