Bail was denied as there were no fresh grounds and the offences were of a serious nature.
Summary
Amirak Manjhi was charged under Sections 302, 201 and 120B of the Indian Penal Code for the murder of an informant's husband. He surrendered in 2024 after being an absconder for over 15 years and has been in custody since 8 November 2024. The petitioner sought regular bail, but the High Court noted the gravity of the offences and the lack of any fresh ground for bail. The court also considered his prior absconding and the seriousness of the conspiracy charge. Consequently, the court dismissed the second bail application, upholding its earlier order denying bail.
Issues considered
- Whether bail can be granted to an accused charged with murder, destruction of evidence and criminal conspiracy given the seriousness of the offences and prior absconding.
