Patna High Court

Rahul Kumar @ Ravi Ranjan Kumar @ Ravi RanjanversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that regular bail could not be granted as the petitioner was sufficiently connected to the alleged offence.

Summary

The petitioner, Rahul Kumar, was arrested in connection with a case of alleged loot on a highway (Pandarak P.S. Case No.185 of 2025) under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023. He applied for regular bail, claiming innocence and having been in custody since 3 December 2025. The State opposed the bail application, arguing that the prosecution had sufficient material linking the petitioner to the crime. The Court examined the evidence and concluded that the material was adequate to connect the petitioner with the loot. Consequently, the Court declined to grant regular bail. The application for regular bail was rejected.

Issues considered

  • Whether regular bail should be granted to the petitioner under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023 given the evidence linking him to the alleged loot.

                                3. As per the prosecution case, the petitioner along

with others is accused of committing loot on the highway.

                                4. Learned counsel for the petitioner submits that

investigation, sufficient materials have come to connect the

petitioner with the crime. Considering the fact that the petitioner

has participated in committing loot on the highway, this Court is

not inclined to grant regular bail to the petitioner.

                                 7. Accordingly, this application for regular bail stands

                    rejected.
