Decided
Disposal
DISMISSED

Holding

The Court denied bail, finding no ground to review its earlier order.

Summary

Sunil Kumar was arrested in connection with a kidnapping and murder case (PS Case No. 337 of 2025) and charged under Sections 103(1), 140(1), 238 and 61(2) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that he was a contract killer who received Rs. 50,000 for the killing, and the vehicle used in the crime was recovered. The petitioner applied for regular bail for the second time, claiming the account involved belonged to his brother and that he was not involved in the crime. The trial had already commenced and one witness had been examined. The Court held that there were no sufficient grounds to revisit its earlier order and dismissed the bail application, emphasizing that its observations were only prima facie and would not affect the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the alleged offences and the progress of the trial.
