The Court granted bail to the petitioner.
Summary
Mrityunjay Singh was arrested in connection with a murder case (Sheosagar P.S. Case No. 316 of 2025) where a gun he allegedly handed to Sunil Singh was used to shoot Shivani Kumari, who later died. The prosecution alleged that Singh was complicit in the offence, while Singh contended he merely gave the gun and did not fire, asserting that Sunil Singh’s confessional statement exonerated him. The State opposed bail, citing Singh’s three prior criminal cases and labeling him the main culprit. Singh’s counsel argued lack of direct involvement and that the confessional statement was made to protect Singh. After hearing both sides, the Court considered the facts, the nature of the alleged offence, and Singh’s custody since October 2025, and decided to grant bail on a bond of Rs.10,000 with two sureties.
Issues considered
- Whether the petitioner is entitled to bail despite alleged involvement in a murder under the Arms Act and other penal provisions.
- Whether the act of handing over a firearm constitutes an offence warranting denial of bail.
- Impact of the petitioner’s prior criminal antecedents on the bail decision.
- Reliability of the co-accused’s confessional statement in influencing bail.
