The Court held that the anticipatory bail order could be modified to grant an additional four‑week period for surrender and furnishing the bail bond.

Summary

The petitioner, Rakesh Mandal, had been granted anticipatory bail by the Patna High Court on 13 August 2025, with a direction to surrender and furnish a bail bond within four weeks. He filed an application on 13 February 2026 seeking modification of that order, alleging mis‑communication and other reasons prevented compliance within the stipulated period. The petitioner’s counsel argued for an extension of time to comply with the surrender and bail‑bond requirement. The Court considered the justification provided and found no prejudice to the State. Consequently, the Court allowed the modification, granting an additional four‑week period for surrender and furnishing the bail bond, subject to a cost of Rs. 1,000 payable to the Legal Services Authority.
