Chhotu Kumar @ Chhotu ChaudharyversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to specified conditions, under Section 438(2) CrPC and Section 482(2) B.N.S.

Summary

Petitioner Chhotu Kumar sought anticipatory bail fearing arrest in a case (Katra P.S. Case No. 300 of 2025) under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, alleging that he was falsely implicated because the alleged illicit liquor was stored in a jointly owned house with his brother. The prosecution alleged that the petitioner fled the scene after his brother was caught with 30 litres of illicit liquor. The petitioner argued he had no involvement, a clean antecedent, and was named only due to joint ownership. The State opposed the bail. The High Court, applying Section 438(2) of the CrPC and Section 482(2) of the B.N.S., granted anticipatory bail subject to a Rs.10,000 bond, two sureties, and several conditions including personal presence in court and verification of antecedents.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the allegations under the Bihar Narcotic Substances Act and the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the petitioner is likely to abscond, tamper with evidence, or repeat the alleged offence.
