Suraj Bhan Singh @ PritamversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court dismissed the bail application, refusing to review its earlier order.

Summary

The petitioner, Suraj Bhan Singh, sought regular bail in a murder case (PS Jagdishpur Case No. 291 of 2024) involving offences under Sections 103, 238, 61(2) and 3(5) of the BNS. The prosecution alleged that the petitioner, along with Narendra Singh (Fantoosh) and others, lured the deceased Ankit Aditya to a secluded place and strangulated him. The petitioner argued that he had been in custody since 28‑08‑2024 and that the trial was delayed, with only four of eight witnesses examined, invoking his right to a speedy trial. The informant’s counsel noted that one witness had died, another was injured, and the remaining official witnesses were to be examined soon, indicating the trial was nearing completion. The court, after considering these submissions, declined to revisit its earlier order and dismissed the bail application, directing the Superintendent of Police to ensure the remaining official witnesses appear for trial.

Issues considered

  • Whether the petitioner is entitled to regular bail in view of the alleged delay and the right to a speedy trial
