The Court granted anticipatory bail to the petitioner, subject to specified conditions and a cash bond.
Summary
Mithun Ram, also known as Mithun Kumar, applied for anticipatory bail after police alleged that he was involved in the sale of illicit liquor, leading to the seizure of 10 litres of country‑made liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner contended that the seized liquor was not on his premises, he had no connection with the business, and he was already on bail in two similar cases, arguing that his prior criminal antecedents should not preclude bail. The State opposed the bail, asserting that the allegations warranted detention. The High Court, after considering the submissions, granted anticipatory bail subject to a cash bond of Rs 10,000 with two sureties and several conditions, including personal attendance before the trial court and verification of criminal antecedents. The order emphasized that any observations made would not affect the trial, and bail could be cancelled for non‑compliance.
Issues considered
- Whether anticipatory bail should be granted in a case involving alleged contravention of Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the petitioner’s prior criminal antecedents and previous bail in similar cases justify denial of anticipatory bail.
- Whether the alleged seizure of liquor on premises not owned by the petitioner is sufficient ground to refuse bail.
