Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as the petitioner was not a flight risk and the statutory conditions for bail were satisfied.

Summary

The petitioner, Ranjeet Singh, husband of a deceased woman, applied for bail in a dowry death case registered under Sections 80(1), 238(a) and 3(5) of the Bihar Narcotic Substances Act, 2023. He claimed innocence, alleging that the death was due to illness and that he was falsely implicated. The charge had already been framed and the petitioner had been in custody since 30 May 2025. The court considered the length of custody, the nature of the allegations, and the statutory provisions governing bail. It was satisfied that the petitioner was not a flight risk and that the bail conditions were adequate. Consequently, the court ordered his release on bail upon furnishing a bail bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused in a dowry death case under Sections 80(1), 238(a) and 3(5) of the B.N.S., 2023.
  • Whether the accused’s claim of false implication and the circumstances of the death justify bail.
