The court granted regular bail to the petitioner.

Summary

Petitioner Raja Singh was arrested in connection with a case under sections 25(1‑B)a, 26 and 35 of the Arms Act after a loaded pistol, cash and gold jewellery were recovered from his house. He claimed innocence, stating that only one pistol was incriminating and the other items were his own, and he had been in judicial custody since 2 September 2025. The State opposed bail, highlighting seven prior criminal convictions. After hearing both sides, the Patna High Court considered the facts, the nature of the offence, and the petitioner’s custody duration, and decided to grant regular bail. The court ordered his release on a bail bond of Rs 10,000 with two sureties, subject to conditions of cooperation in trial and regular attendance at the police station.

Issues considered

  • Whether regular bail should be granted to the petitioner in a case under the Arms Act involving recovery of a loaded pistol, cash and gold jewellery.
  • Whether the petitioner’s criminal antecedents justify denial of bail.
