Holding
The Court dismissed the bail applications, holding that the petitioners' participation in the crime precludes the grant of bail.
Summary
The Patna High Court considered three bail petitions filed by Pranav Kumar, Pintu Kumar Sharma, and Hariom Kumar, who were accused in a robbery case (PS Case No. 362 of 2025) involving loot of Rs.2,43,000 and assault on an informant. The prosecution alleged that the petitioners participated in the loot, were present at the scene, and were named in a co‑accused's self‑inculpatory statement, and also highlighted their prior criminal antecedents. The charges were under Sections 309(6) and 3(5) of the B.N.S and Section 26(1‑b) of the Arms Act. The State opposed bail, arguing the seriousness of the offence and the petitioners' involvement. After evaluating the facts, the Court concluded that the petitioners were participants in the crime and therefore were not entitled to bail. Consequently, the bail applications of all three petitioners were dismissed.
Issues considered
- Whether bail should be granted to the accused under Sections 309(6), 3(5) of the B.N.S and Section 26(1‑b) of the Arms Act in view of their alleged participation in the robbery and prior criminal antecedents.
