The Court granted anticipatory bail to the petitioner, subject to specified conditions.
Summary
Satya Narayan Oraon, a Sub‑Post Master at Forbesganj, was implicated in an FIR (Case No. 281 of 2025) for alleged misappropriation of Rs 9,91,634, alleged under sections 316(5) and 318(4) of the BNS. The petitioner filed a petition for anticipatory bail, submitting that the disputed amount had been deposited in the Sub‑Post Office and that he had no prior criminal record. The State opposed the bail, maintaining the allegation of misappropriation. The Court, after considering the submissions and the deposit of the amount, granted anticipatory bail with a bond of Rs 10,000 and two sureties, imposing conditions such as appearance before the trial court, non‑tampering with witnesses, and refraining from further offences. The order directed that bail would be effective upon arrest or surrender within four weeks of the order.
Issues considered
- Whether anticipatory bail should be granted to the petitioner despite the FIR for alleged misappropriation under sections 316(5) and 318(4) of the BNS
- Whether the deposit of the alleged misappropriated amount and the petitioner’s clean record justify the grant of bail
