Decided
Disposal
DISMISSED

Holding

Bail was denied to the petitioner.

Summary

The petitioner, Lalan Yadav, applied for bail in a case registered under Sections 302 and 201 of the Indian Penal Code for the alleged murder of his wife. The prosecution alleges that the petitioner, together with co‑accused, killed the deceased and disposed of her body, which was later found in a mutilated state. The petitioner’s counsel highlighted his long marriage, two children, and claimed the wife left the house voluntarily before her death. The State opposed bail, emphasizing the brutality of the crime and the absence of any missing‑person report filed by the petitioner. Considering the seriousness of the offence and the circumstances, the Court declined to grant bail and dismissed the application.

Issues considered

  • Whether bail should be granted to an accused charged with murder (IPC s.302) and concealment of evidence (IPC s.201) in view of the nature of the crime.

                                 2. The petitioner seeks bail in connection with Sigori

Sections 302, 201 of the Indian Penal Code.

                                 3. As per the prosecution case, the petitioner, who is

the husband of the deceased, along with other accused, is said to

                   have killed the deceased.

                                 4. The petitioner is in custody since 26.05.2025.

                                 5. Learned senior counsel for the petitioner has

submitted that the petitioner was married around 12 years back

petitioner on her own and subsequently her dead body was

                    found.

                                 6. Learned counsel for the State has opposed the

application of the petitioner for grant of bail.

                                 7. From the FIR, it appears that the deceased was

brutally cut into pieces and her dead body was found.

                                 8. Considering the brutal murder of the deceased and

considering the fact that no missing report was submitted to the

police by the petitioner with regard to his wife/deceased, this

Court is not inclined to grant bail to the petitioner.

                                 9. Accordingly, this application is dismissed.

                                                               (Sandeep Kumar, J)
