DISMISSED

Holding

The bail application is dismissed.

Summary

The petitioner, Satyendra Kumar, applied for bail in a case registered under Sections 408, 379 and 34 of the Indian Penal Code, alleging that he failed to pay rent for a truck given to him by the informant. He has been in custody since 10 July 2024 and is alleged to be involved in 79 other criminal cases. The prosecution argued that the petitioner’s conduct amounted to criminal breach of trust and theft. The court considered the seriousness of the offences and the petitioner’s extensive criminal antecedents. Concluding that the circumstances did not merit bail, the court dismissed the bail application, noting that its observations were limited to this application and did not prejudice the trial’s merits.

Issues considered

  • Whether bail should be granted to the petitioner given the nature of the offences under Sections 408, 379 and 34 IPC
  • Whether the petitioner’s antecedent of being accused in 79 other cases warrants denial of bail
