Patna High Court

Ranjit SadaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a bond and sureties.

Summary

The petitioner, Ranjit Sada, was arrested after police raided his house and seized a Desi katta and five live cartridges, alleging violations of Sections 25(1‑b)(b) and 26 of the Arms Act. He claimed innocence, arguing that the seizure was illegal because the seizure list lacked an independent witness’s signature and that the police failed to comply with Section 100 of the CrPC. The court noted his clean antecedent and that he had been in custody since 1 November 2025. Considering the procedural lapses and his personal circumstances, the court granted bail on a bond of Rs 10,000 with two sureties, imposing conditions regarding a relative as bailor, physical presence in court, and cancellation for non‑appearance. The bail order was pronounced by Justice Alok Kumar Sinha.

Issues considered

  • Whether bail should be granted to the accused under Sections 25(1‑b)(b) and 26 of the Arms Act.
  • Whether the seizure of weapons was valid in view of the absence of an independent witness’s signature on the seizure list.
  • Whether the police complied with the requirements of Section 100 of the Criminal Procedure Code.

3 19-03-2026 Heard the learned counsel for the petitioner and

                   learned APP for the State.

                                2. The petitioner seeks bail in connection with Alauli

P.S.Case No. 481 of 2025 registered for the offence punishable

under Sections 25(1-b)(b), 26 of the Arms Act.

                                3. As per the prosecution case, the informant received

a secret information regarding storage of illegal weapons by the

petitioner in his house. Thereafter, the police personnel raided

the house of the petitioner and seized one Desi katta as well as

five live cartridges from his house and in the process he was

          also nabbed.

                           4. The learned counsel for the petitioner has

submitted that the petitioner is innocent and has falsely been

implicated in this case due to ulterior motives. It is further

submitted that in the present case the police have not followed

the mandate of the provision of Section 100 of the CrPC.

                       5. Taking note of the fact that the petitioner is having

clean antecedent and is in custody since 01.11.2025 and further

that the seizure list prepared does not bear the signature of any

independent witness, which puts a question mark on the legality

and validity of the seizure itself, let the petitioner, above-named,

be released on bail on furnishing bail bond of Rs. 10,000/-(ten

thousand) with two sureties of the like amount each to the

satisfaction of the court concerned in connection with Alauli

dates without substantial reason or in violation

petitioner will be liable to be cancelled by the
