Patna High Court

Deepak Kumar Singh @ Deepak KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner upon the condition of a Rs.10,000 bond with two sureties.

Summary

The petitioner, Deepak Kumar Singh, was arrested in connection with a violent incident alleged to involve assault with lathis, danda and an iron rod, resulting in injuries to an informant and her family. He faced charges under multiple sections of the Bharatiya Nyaya Sanhita, 2023, including offences of murder, attempt to outrage modesty and criminal conspiracy. The petitioner claimed he was falsely implicated in a land‑dispute related fight and that the co‑accused Vikash Kumar had been granted anticipatory bail. The State opposed his bail application, citing the seriousness of the offences. After hearing both sides, the court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, thereby granting bail.

Issues considered

  • Whether the petitioner is entitled to bail despite the gravity of the offences under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the grant of anticipatory bail to a co‑accused influences the bail decision for the petitioner.
