Patna High Court

Golu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner subject to strict conditions.

Summary

The petitioner, Golu Kumar, was arrested in connection with the alleged recovery of 4.5 litres of illicit country‑made liquor from his residence under Section 3(a) of the Bihar Prohibition and Excise Amendment Act. He contended that the seizure was unlawful, no contraband was found in his possession, and the seizure list lacked independent witnesses, violating procedural requirements of the B.N.S.S. and the Code of Criminal Procedure. The State opposed the bail application. After hearing both sides, the court granted regular bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties and comply with several procedural conditions, including regular reporting to the police and non‑tampering with evidence. The application was allowed, and the petitioner was released on bail pending trial.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 3(a) of the Bihar Prohibition and Excise Amendment Act.
  • Whether the seizure and recovery process complied with the mandatory provisions of the B.N.S.S. and the Code of Criminal Procedure.
  • Whether the petitioner’s continued custody is justified in view of the alleged procedural irregularities.
