Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

Aman Kumar was arrested in connection with a case involving alleged abduction, assault, and murder, charged under multiple sections of the Indian Penal Code (341, 342, 324, 326, 307, 364, 302, 201, 120B and 34). The prosecution alleged that Kumar and co‑accused abducted the son of an informant, subjected him to electric shock and other injuries, and the victim later died. The petitioner pleaded innocence, asserted that the allegations were vague, highlighted his clean antecedents and noted that he had been in custody since 7 January 2026. The State opposed bail, citing the seriousness of the offences. The Court, after considering the nature of the accusations, the petitioner’s clean record and the period of custody, granted regular bail on a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted in a case involving serious offences such as murder, attempt to murder and abduction.
  • Whether the petitioner’s clean antecedent and period of custody justify bail despite the gravity of the charges.

Sitaram Memorial Inter School. Having received the

information, informant's wife and family members took the

victim to hospital where he was declared dead by the doctor

                                     4. Learned counsel for the petitioner submits that

of assault is general and omnibus and there is no allegation of
