Patna High Court

Ravi KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court dismissed the petitioners' application for anticipatory bail.

Summary

The petitioners, Ravi Kumar, Amod Kumar Ray and Vikash Ray, applied for anticipatory bail in a case registered under Sections 8, 20(b)(ii)(B) and 29 of the NDPS Act, alleging that they might be arrested for allegedly helping co‑accused and planting drugs. The High Court examined the allegations and the seriousness of the offences. It held that the nature of the accusations did not merit the grant of anticipatory bail. Consequently, the application for anticipatory bail was dismissed and the petitioners were ordered to surrender to the lower court within four weeks to seek regular bail, failing which the police would be directed to arrest them. The Court clarified that its observations were limited to the anticipatory bail application and would not prejudice any later proceedings.
